Nicholas Rechter

The people of the State of New York by the Grace of God free and Independent:

To Peter Getman of the town of Palatine in the county of Montgomery send Greeting:

Whereas at the Village of Johnstown in the County of Montgomery before Tobias A. Stoutenbergh Esquire Surrogate of our said County the last Will and testament of Captain Nicholas Rechter late (an united States invalid pension) of the town of Palatine aforesaid who died November the twenty fifth in the year of our Lord one thousand eight hundred and twenty (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us; and the said deceased having whilst he lived and at the time of his death goods, chattels & credits within this State by means whereof the proving and registering the said Will and the granting administrations of all and singular the said goods , chattels, and credits and who the auditing, allowing, and final discharging the account thereof doth belong unto us; and we being serious that the goods, chattels, and credits of the said deceased, may be well and faithfully administered, applied and disproved of according to the said Will, do grant unto you the said Peter Getman the administration of all and singular, the goods, chattels, and credits of the said Nicholas Rechter deceased with the Will of the said Nicholas Rechter annexed with full power by then presents to administer and faithfully disprove of all and singular the said goods, chattels and credits, to ask, demand, recover and secure the debts, which unto the said deceased whilst living and at the time of his death did belong; and to pay the debts which said deceased did owe so far as such goods, chattels, and credits will thereto extend and the law requires: Hereby requiring you to make or cause to be made a true and proper inventory of all and singular the goods, chattels, and credits of the said deceased, which have or shall come to your hands, possession or knowledge and the same so made to exhibit or cause to be exhibited into the office of the Surrogate of the said County of Montgomery at or before the Expiration of six calendar months from the date hereof, and who to render a just and true account of administration when thereunto required; and we do by then presents depute constitute and appoint you the said Peter Getman administrator of all and singular the goods, chattels, and credits which were of the said Nicholas Rechter with the Will of the said Nicholas Rechter annexed.  In testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed: Witness Tobias A. Stoutenbergh Esquire Surrogate of the said county at the Village of Johnstown, the first day of September in the year of our Lord one thousand eight hundred and twenty three, and of our Independence the forty-eighth.

In the name of God Amen I Nicholas Rechter of the town of Palatine in the County of Montgomery and State of New York being weak in body but still of disproving mind and memory do make and ordain this my last Will and testament in manner following that is to say I command my soul to Almighty God who gave it praying that for the worthiness there is in Christ he will accept of the same my body I commend to the earth out of which it was made, to be intered [sic] after my decease in a decent and Christian like manner at the expence [sic] of my executors herein after named.  Having in my life time provided for all my children I give and bequeath all the rest and residue of my personal estate which I shall be possessed of at the time of my death to my son in law Peter Fox his heirs and assigns forever  Item I do by these presents nominate, constitute & appoint Phillip R. Frey the sole executor of this my last Will & testament, hereby revoking all other wills testaments & codicils by me heretofore made.  In testimony whereof I have hereunto subscribed my name and affixed my seal this sixteenth day of March in the year of our Lord one thousand eight hundred and twenty.

Signed sealed published and declared by the testator to be his last Will and testament in the presence of us who in his presence and in the presence of each other subscribed the same as witnesses.

Be it remembered that on the first day of September in the year of our Lord one thousand eight hundred and twenty three personally appeared before me Tobias A. Stoutenbergh Surrogate of the County of Montgomery William W. Fox Junior who being duly sworn deponith [sic] and saith that he saw Nicholas Richter was at the time thereof of sound and disproving mind and memory and understanding, that this deponent subscribed his name thereto as a witness to the execution thereof in the presence of the said Nicholas Richter the testator, and that he at the same time saw John Frick and Larry Fox subscribe their names thereto as witnesses to the execution thereof also in the said testators presence.

The preceeding [sic] an apris of the last Will and testament of Nicholas Rechter deceased of the certificate of the proof thereof and of the letters of Administration thereon.

Be it remembered that on the said first day of September last mentioned personally appeared before me the said Surrogate Peter Getman Administrator of all and singular the goods, chattels, and credits of Nicholas Rechter deceased with the will of the said Nicholas Rechter annexed and was duly sworn as an Administrator.
