Will and probate of Robert S. Lenardson (1782-17 Jun 1838)

Written August 3, 1836. Root, NY

In the name of God Amen, I Robert S. Lenardson of the town of Root in the County of Montgomery being weak in body but of sound mind and memory blessed be Almighty God for the same, do make this my last will and testament in manner and form following that is to say I do devise and bequeath unto my beloved sons Jacob Lenardson, John S. Lenardson and James Lenardson all my real estate situate[d] in the towns of Glen and Root in said County to them their heirs and assigns forever. Subject to the support of my wife Harriet as hereafter Stated.

Secondly I do devise and bequeath unto my said three sons above mentioned all my personal property and choses [?] in action of whatever name or nature Subject to the payment of all my just debts.

Thirdly, I do give devise and bequeath unto my beloved daughters, Maria Dopp, Elizabeth Lenardson, Nancy Lenardson and Eleanor Lenardson Two hundred dollars each to be paid to them respectively by my three sons above named, each an equal part, one half to be paid within one year after my death: And the other half or residue within two years after my death.

Fourthly I do give devise and bequeath unto my beloved daughter Ida wife of Noah Smith one cow to be paid to her within one month after my death by my said three sons which together, with what I have heretofore given her, is in full satisfaction of her portion of my estate.

Fifthly I do give devise and bequeath to my beloved wife Harriet a good comfortable support out of my estate to be furnished her by my said three sons so long as she shall remain my widow and no longer, and I do hereby charge my said real estate above devised to my sons with her support. And I do hereby declare that such support for my said wife if accepted by her shall be in full and in lieu of all right of dower on her part out of my real estate. And I do hereby constitute and appoint my friend Peter Van Evera and my sons Jacob and John S. Lenardson Executors of this my last will and testament. In Witness whereof I have hereunto put my hand and seal this 3 day of August 1836.

Probate Record Dated August 6, 1838

State of New York Montgomery County - Be it remembered that at a Surrogates Court held for the County of Montgomery at the Surrogates Office in the Village of Fonda on this sixth day of August in the year of our Lord one thousand eight hundred and thirty eight the last will and testament of Robert S. Lenardson late of the said County deceased (a copy whereof is hereunto annexed) was admitted to probate by the said Surrogate after a citation to the widow, heirs, and next of kin to the said deceased, issued, served, returned and filed according to law. Satisfactory proof having first been made of the circumstances of the delivery and possession of the said will. And also of the execution thereof by the depositions of David F. Lacia and Henry Stanton subscribing witnesses to the said will copies of which depositions are also hereunto annexed. Whereupon I the said Surrogate upon the proof of aforesaid being satisfied of the genuineship and validity of the said will order that the same be admitted to probate and that letters testamentary thereon be granted. In testimony whereof I the said Surrogate have hereunto set my hand and affixed the seal of my office. Done at the Village of Fonda aforesaid the day and year aforesaid.

Montgomery County Surrogate Court. In the matter of the probate of the will of Robert S. Lenardson deceased which will relates to both real and personal estate Henry Stanton of the town of Canajoharie in the County of Montgomery being first duly sworn deposetto[?] and saith that he saw the said Robert S. Lenardson deceased seal and execute the instrument now sheure (sic) unto lives [?]this deponent which said instrument purports to be the last will and testament of the said Robert S. Lenardson deceased and bears date the third day of August in the year of our Lord one thousand eight hundred and thirty six, that he heard the said Robert S. Lenardson publish and declare the same as and for his last will and testament. That at the time thereof the said Robert S. Lenardson was of sound and disposing mind memory and understanding, of full age, and not under any restraint to the best of his knowledge and belief, and that he did subscribe his name to said will as a witness to the execution thereof in the presence of and at the request of the said testator. And that he at the same time saw David F. Ladia the other witness to said will subscribe his name thereto as a witness to the execution thereof in presence of and at the request of the said testator Henry Stanton. Subscribed and Sworn to before me the 6th day of August 1838.

Ladia of the town of Canajoharie in the County of Montgomery being first duly sworn deposetto and saith that he saw the said Robert L. Lenardson deceased seal and execute the instrument now shown unto here this deponent which said instrument herein ports to be the last will and testament of the said, Robert S. Lenardson deceased and bears date of the third day of August in the year of our Lord one thousand eight hundred and thirty six that he heard the said Robert S. Lenardson publish and declare the same as and for his last will and testament, that at the time thereof the said Robert S. Lenardson was of sound and disposing mind, memory, and understanding, of full age, and not under any restraints to the best of his knowledge and belief and that he did submit this name to said will as a witness to the execution thereof in the presence of and at the request of the said testator and that be at the same time saw Henry Stanton the other witness to said will subscribe his name thereto as a witness to the execution thereof in presence of and at the request of the said testator, D. F. Ladia Subscribed and sworn to before me the 6th day of August 1838.
