The 1801 Will of Hendrick Hess of Canajoharie

"The Herkimer / Montgomery site mentions a will abstract for Hendrick Hess. I have the entire will which I am sending by attachment. It was printed in the family history section of the St. Johnsville Enterprise and News in 1933. The will itself was written in 1801 and probated in 1810. I have the original newspaper which included this article."

"As printed in the genealogy / family history pages of the St. Johnsville, New York, Enterprise and News on Wednesday, February 13, 1933.

    In the name of God, amen: I, Hendrick Hess, of the town of Canajoharie, in the country of Montgomery and State of New York, considering the uncertainty of this mortal life, being of sound and perfect mind and memory, blessed by God therefore, do make and publish this my last will and testament in a manner and form following that is to say:
First, I will and order that all my just debts and funeral expenses by paid.

    Also, I give, devise and bequeath unto my son Henry Hess Junior, his heirs and assigns forever, the farm I now live on with all my lands in Freys Bush, will all the farming utensils thereunto belonging; subject nevertheless to the bequest next herein following, and to the payment of the money herein after ordered to by paid my him.

    Also, I give and bequeath unto my wife Mary Elizabeth during her life all my moveable estate and farming utensils, my house and barn and one third part of the products of my farm which shall be delivered to her fit to be taken to market, always and understanding that the farming utensils are to me be made use of in the cultivation of the farm, and the horses in working the same if Henry desires it.

    Also, after my wife's decease, I give and bequeath unto my sons George and Henry all the horses then remaining on my farm.

    Also, I give and bequeath unto my daughters Susanna, Magdalen, Elizabeth, Catharine and Margaret and to Anna, Maria, Elizabeth and Susanna, children of my deceased daughter Maria, the sum of three hundred and seventy-five dollars, to wit; sixty-two dollars and fifty cents to each of my said daughters and sixty-two dollars and fifty cents to the four children above named of my daughter Maria deceased, two hundred and fifty dollars of the said sum I will and order to be paid by my son Henry and one hundred and twenty five dollars of the said sum I will and order to be paid by my son George who has been advanced and provided for by me in my life time.

    Also, I give and bequeath unto my said five daughters, and to my said four grand daughters, all my household furniture, the horned cattle, sheep and hogs, remaining at my wife's decease, to wit, one sixth part to each of my said daughters and one sixth part to my said grand daughters.

    Also, I wall and order that if my said grandchildren, Anna, Maria, Elizabeth and Susanna continue in my family until they marry, they and each of them shall have one cow, one calf, and one chintz gown.

    Also, the rest and residue of my personal estate at my wife's decease i give and bequeath unto my said sons, daughters and grand daughters to be divide so that my said grandchildren have one eighth and my sons and daughters each one eighth.

    Also, I nominate, constitute, and appoint my wife, Mary Elizabeth to be Executrix and my friends and neighbors, George W. Gerlach and Henry I. Feiling to be Executors of this my last Will and Testament hereby revoking all former Wills Testaments or Codicils by me made.

In witness whereof I have hereunto set my hand and seal the twenty sixth day of August in the year of our Lord on thousand eight hundred and one.

"I would like to submit the attached transcription of the reading of the probate of a will for Polly Veeder. I don't know the exact date of the newspaper clipping. I found this newspaper clipping in a box of photos belonging to my grandfather, Guy McDonald Garlock, born in Muscatine, Iowa, who was a grandson of the John S. Garlock mentioned in the article.         The next of kin of Polly Veeder, late of the town of Mohawk, in the County of Montgomery, N.Y., deceased SEND GREETING.

        Whereas George C. Simpson of the town of Mohawk in the County of Montgomery, has lately applied to our Surrogate of Montgomery County, to have a certain instrument in writing relating to personal estate only duly proved as a last will and testament of Polly Veeder, late of the town of Mohawk, in said county, deceased. Therefore, you and each of you, are hearby cited and required personally to be and appear before our Surrogate of our County of Montgomery, at his office in the village of Fonda in said county, on the nineteenth day of February, 1877 at 10 o'clock in the forenoon of that day, then and there to attend to the probate of said last will and Testament.

        In Testimony Whereof, we have caused the seal of our Surrogate's Court of said County to be hereunto affixed. Witness. S. Pulver Heath, Surrogate of our County of Montgomery, at the village of Fonda in said County, the fourth day of December, the year of our Lord. One Thousand Eight Hundred and Seventy-Six.
