Simon Pieterse Van Antwerp

In the name of God amen, I Simon Van Antwerp of the Town of Charleston in the County of Montgomery being weak in body but of sound and perfect mind and memory blessed be almighty God for the same, do make and publish this my last Will and Testament in manner and form following (that is to say)

First, I give and bequeath unto my beloved Wife Rebecca her wearing Apparel.  I also wish after my decease my body be buried in a christianlike and decent manner.  I do also wish that all my just Debts be paid out of real Estate by my Sons Peter, John and Abraham.  I also give an bequeath to my said Wife Rebecca during her natural life all my household furniture and after her death her wearing Apparel and said household furniture to be equally divided between my four Daughters Margaret, Susannah, Annatie and Sarah.  I do also give an bequeath unto my said Wife all the residue of my personal property during her natural life and after her death to be divided as follows that is to say, my neat Cattle between my aforesaid Daughters, and my Horses and farming Utensils between Sons Peter, John  & Abraham to be equally divided among them.  I do also hereby give and devise my real Estate in manner following, that is to say, my part of Lot No. twenty three, estimated at one hundred and forty two Acres of Land be the same more or less to my Sons John & Abraham Van Antwerp to them their Heirs and Assigns forever.  I do also hereby give and devise to my Son Peter Van Antwerp the Farm piece or parcel of Land I now live on being part of Lot number five estimated at eight Acres of Land be the same more or less, to my said Son Peter his Heirs and Assigns forever.  I do also give and bequeath to my said four Daughters Margaret, Susannah, Annatie and Sarah the rent and reversion of Lot Number thirteen now in the possession of Edward Manning, to be equally divided between them.  It is also my will that my said Wife Rebecca occupy and possess all my real Estate during her natural life time, and also that my Sister Nettie shall remain with my said Wide and be decently supported & maintained out of my Estate bequeathed and devised to my said Wife, and if said Sister Nettie should out life my said Wife Rebecca that than the remainder of her life time she be decently supported and maintained by my three said Sons she pleases, they however not to be accountable for her support and maintenance if she should not choose to live with either of them.  I do also will and devise that my Sons as aforesaid can at any time after my decease such part of my real Estate as they shall agree and think proper sell and dispose off for the purpose of paying my just Debts that I shall owe at the time of my death.  And lastly I do hereby nominate and appoint my three Sons Peter, John, and Abraham to be the Executors of this my last Will and Testament, hereby revoking all former Wills by me made.  In witness whereof I have hereunto set my Hand and Seal the eleventh Day of June in the Year of our Lord one thousand eight hundred and eight.

Signed sealed published and declared by the above named Simon Van Antwerp to be his last Will and Testament, in the presence of us who have hereunto subscribed our names as witnesses in the presence of the Testator.  The word proper first interlined before the execution hereof.

Be it remembered that on the tenth Day 0of October in the year of our Lord One thousand eight hundred and eight personally appeared before me James Lansing Surrogate of the County of Montgomery John Van Petten; and also on the eleventh Day of October in the Year aforesaid personally appeared before me the said Surrogate Benjamin Van Vecthen who being both by me duly sworn severally depose and say that they saw Simon Van Antwerp sign and Seal and heard him publish and declare within Instrument as and for his last Will and Testament: That the said Simon was at the time thereof (according to the best of the knowledge and belief of these Deponents) of sound and disposing mind, memory and understanding:That they saw Jospeh Y Bratt subscribe his name thereto; and that they together with the said Jospeh Y Bratt subscribed their names thereto as Witnesses to the execution thereof in the Testators presence.

The preceding are true copies of the last Will and Testament of Simon Van Antwerp deceased, of the Certificate of the proof thereof, and of the Letters testamentary thereon.

Registered the 11th Day of October 1808.
